One of the great bafflements of my career is why a client hires a marketing company to come up with a logo or brand, then builds their business around this brand, but refuses to protect this brand legally. I have seen it happen time and time again. it is utterly astonishing to me a person or company would invest so much time, effort and energy into building this recognizable brand and yet deny protection of it.
What I usually hear is “Nah, I don’t want to spend that right now, I just spent all that money on creating and building the brand. I’ll wait a while and see if I need it,” and of course they never think they need it, until they do.
We all know the numbers it’s less than $1,000 to copyright your logo, it will cost you upwards of $20,000 to defend you use of your logo if you don’t have the copyright in the event of a lawsuit. Same for a trademark, Less than $1,000 to trademark it and more than $20,000 to defend if you don’t have it.
So why or why would ordinarily smart business people choose to play Russian Roulette instead of playing it smart and protecting their name, their logo and their brand?
